First Rule of Family Law

The end to a relationship is similar to a death in the family.  


You'll experience periods of extreme stress, anxiety, depression and sometimes loss of control.  


The most important thing during this period is to ensure that you have support from family and friends, to surround yourself with the people that matter most.


Spend time eating well and keeping hydrated, burning excess energy by exercising or going for long walks, watching movies and finding a positive outlet until everything is finally resolved.


Second Rule of Family Law

Be reasonable and settle as soon as possible.  


You and your ex-partner entered the relationship based on mutual respect and love.  Now that the relationship has ended, it is also time to divide your assets after giving consideration to your initial contributions at the start of the relationship, your contributions during the relationship and what future needs each of you may have.  


Protracted legal proceedings, unreasonable expectations, unhelpful allegations by either of you against the other only increases your costs meaning that you each receive less as you have paid more to your lawyers.


If you share children, the money that you each spend on lawyers could have been invested in your child or used to support their education and advancement in life.


Third Rule of Family Law

If your ex is being unreasonable, don't let them shatter your future.

Wills & Probate Lawyers

Wills

A Will is a document that clearly sets out your wishes on your death and entrusts to your Executor to obtain a Grant of Probate from the Court proving that this Will is your last Will and how and to whom you wish for your Estate both real estate and personal property to be distributed.


Whilst a Will is personal to the will maker, the will maker has certain obligations to including a moral obligation and or a moral duty to make adequate provisions for its beneficiaries.  If adequate provisions are not made for your beneficiaries, they may bring a claim against your estate seeking a greater proportion of your estate than you had intended to be distributed to that beneficiary.


Careful planning and consideration should be given to whether a certain person is a beneficiary, whether they would be entitled to a portion of your estate and whether you have made adequate provisions in your Will for that beneficiary.


We will guide you so that you can rest in peace knowing that your grieving beneficiaries are not also dealing with the burden of a dispute against your estate.

Probate

Probate is the process of either applying for a Grant of Administration where the deceased passed without a Will or where the deceased did leave a Will and the Executor is required to apply for the Court proving the Will.


We will assist your Executor in obtaining the Grant of Probate or assisting your next of kin in applying for a Grant of Administration, calling in all of your assets, settling your liabilities and then distributing your remainder of your estate to your beneficiaries.
